1. Acceptance of Terms

By accessing or using ScholAR Grade ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. ScholAR Grade is operated by ScholAR Grade LLC ("we," "us," or "our").

2. Description of Service

ScholAR Grade provides an AI-powered academic paper grading tool for educators. The Service includes APA 7th edition compliance checking, AI content analysis, code section evaluation, bulk grading, rubric building, and related features. The Service is intended for use by educators, professors, and academic institutions.

3. Account Registration

To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to update such information as necessary.

4. Free Tier and Paid Plans

The Service offers a free tier with a limit of 15 total grades. Paid subscription plans are available on a monthly ($21/month), yearly ($200/year), or lifetime ($999 one-time) basis. Prices are subject to change with reasonable notice. Refunds are not provided for subscription periods already in use, except as required by applicable law.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to grade papers or content that violates applicable laws, infringes on intellectual property rights, or contains harmful, abusive, or discriminatory material. You are responsible for ensuring you have appropriate rights to upload and process any content submitted to the Service.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by ScholAR Grade LLC and are protected by intellectual property laws. You retain ownership of any content you upload to the Service. By uploading content, you grant us a limited license to process and analyze that content solely for the purpose of providing the grading Service.

7. AI-Generated Results

Grading results are generated by AI and are provided for informational and educational purposes only. AI-generated grades and feedback should be reviewed by a qualified educator before being communicated to students. We do not guarantee the accuracy, completeness, or suitability of any AI-generated output. You are solely responsible for any grading decisions made based on the Service's output.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ScholAR Grade LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
